Privacy Policy
1. General Conditions.

1.1. This Privacy Policy describes, how SIA MV Health, REG.NO.40203555296, LEGAL ADDRESS Riga, Braslas iela 22B, LV-1035 (hereinafter also referred to as “the Data Controller”) collects, processes and stores personal data obtained by mvhealth.eu from its customers and persons visiting the homepage (hereinafter referred to as “the Data Subject” or “you”).
1.2. Personal data is any information referring to an identified or identifiable natural person, i.e., the Data Subject. Processing is any activity related to personal data, for example, collection, recording, modification, use, viewing, deletion or destruction.
1.3. The Data Controller observes the statutory data processing principles and can confirm that personal data is processed in accordance with the effective laws and regulations.

2. Collection, Processing and Storage of Personal Data.
2.1. The Data Controller obtains, processes and stores personally identifiable information mainly using the online store website and e-mail.
2.2. By visiting and using the services provided at the online store, you agree that any information provided is used and managed in accordance with the purposes stated in this Privacy Policy.
2.3. The Data Subject is responsible for ensuring that the submitted personal data is correct, accurate and complete. Deliberate provision of false information is considered a violation of our Privacy Policy. The Data Subject is obliged to immediately notify the Data Controller of any changes to the submitted personal data.
2.4. The Data Controller is not responsible for any loss caused to the Data Subject or third parties, resulting from provision of false personal data.

3. Processing of the Customers’ Personal Data
3.1. The Data Controller may process the following personal data:
3.1.1. Name, surname
3.1.2. Date of birth
3.1.3. Contact information (e-mail address and/or phone number)
3.1.4. Transaction data (purchased products, delivery address, price, payment information etc.).
3.1.5. Any other information submitted to us during purchase of the services and products offered on the website or while contacting us.
3.2. In addition to the aforesaid, the Data Controller is entitled to verify accuracy of the submitted data, using available public registers.
3.3. The legal basis of processing of personal data is Article 6, Paragraph 1, Subparagraphs a), b), c) and f) of the General Data Protection Regulation:
a) the data subject has given consent to the processing of his or her personal data for one or more specific purposes;
b) processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract;
c) processing is necessary for compliance with a legal obligation to which the controller is subject;
f) processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.
3.4. The Data Controller stores and processes personal data of the Data Subject as long as at least one of the criteria listed below is fulfilled:
3.4.1. The Personal Data is required for the purposes it has been obtained;
3.4.2. As long as the Data Controller and/or
the Data Subject can exercise their legitimate interests pursuant to the statutory procedure, for example, submit objections or bring an action to the court;
3.4.3. As long as there is a legal obligation to store the data, for example, in accordance with the Accounting Law;
3.4.4. As long as there is effective consent of the Data Subject for processing of the respective personal data, if there is no other legal basis for processing of personal data.
Upon expiry of the conditions mentioned in this paragraph, also the period of storage of the Data Subject’s personal data expires and all the respective personal data is irreversibly deleted from computer systems and electronic and/or printed documents that have contained the respective personal data, or these documents are anonymised.
3.5. To fulfil our obligations towards you, the Data Controller may transfer your personal data to cooperation partners and data processors that perform processing of the necessary data on our behalf, for example, accountants, courier services etc. The data processor is the controller of personal data. Processing of payments is ensured by the payment platform makecommerce.lv; therefore, our company transfers the personal data required for execution of payments to the platform owner Maksekeskus AS.
Upon request, we may transfer your personal data to state and law enforcement institutions in order to defend our legal interests upon necessity, drafting, filing and defending legal claims.
3.6. While processing and storing personal data, the Data Controller implements organisational and technical measures to ensure protection of personal data against accidental or unlawful destruction, alteration, disclosure and any other unlawful processing.

4. Rights of the Data Subject
4.1. According to the General Data Protection Regulation and laws and regulations of the Republic of Latvia you have the following rights:
4.1.1. To access own personal data, receive information about its processing, and to request an electronic copy of your personal data, as well as the right to transfer this data to another controller (data portability);
4.1.2. To request rectification of incorrect, inaccurate or incomplete personal data;
4.1.3. Delete own personal data (“to be forgotten”), except the instances, when the law requires saving such data;
4.1.4. To revoke own previously given consent for processing of personal data;
4.1.5. Restrict processing of own data – the right to request us to completely stop processing of all your personal data temporarily;
4.1.6. To address the Data State Inspectorate
A request for exercising your rights can be filed by filling out a form on site in Riga, Braslas iela 22B, LV-1035, or by submitting the request electronically, sending a message to the customer support service info@mvhealth.eu

5. Final Provisions
5.1. This Privacy Policy is developed in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), and the effective laws of the Republic of Latvia and the European Union.
5.2. The Data Controller is entitled to make changes or additions to the Privacy Policy at any moment and without a prior notice. Such corrections shall come into force after their publishing on the homepage mvhealth.eu.
